Fiancée - Prospective Marriage Visa

Fiancée Visas known in immigration terms as a Prospective Marriage Visa are for applicants who wish to enter Australia and get married within a 9 month period of time. The marriage must be to an Australian Citizen, permanent resident or qualifying New Zealand Citizen.

Applications for Fiancée visas are made under subclass 300

How does the application process work for a Fiancée Visa?

Applications can only be made from outside of Australia.

How long does the temporary visa last for?

The visa is purely a temporary visa that allows the applicant up to 9 months to get married.

What responsibilities does the Fiancée (sponsor) have?

The sponsor must be prepared to sponsor the applicant and the marriage must take place within 9 months – it should be noted that the marriage itself does not have to place in Australia but has to be within 9 months of the being granted the prospective marriage visa.

What happens after 9 months and the Prospective marriage Visa expires?

After the marriage has taken place the applicant should apply for a partner visa.

What does a Prospective Marriage Visa allow you to do?

  • Before you marry your fiancée you must enter Australia
  • You have the ability to leave and enter Australia as many times as you wish before the expiry of the visa (9) months
  • You have permission to work in Australia
  • Upon marriage you can apply for a Partner visa
  • You are allowed to Study (no have access to government funding)
  • The ability to access Australia's medical expenses and hospital care assistance scheme, Medicare, but only if you are in Australia and have already applied for a Partner visa.

What is the eligibility criteria for a Prospective Marriage Visa?

There are various criteria to this and it should be remembered that the visa is to facilitate applications from individuals who have a genuine intent to marry and reside with their intended spouse as man and wife.
  • The fiancée must be sponsored by an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
  • Both parties need to be 18 years of age at the time of the intended marriage, otherwise permission must have been given by an Australian court if over 16 and under 18.
  • Same sex couples should apply under the partner visa
  • You must have met in person and as adults your fiancée (this applies to arranged marriages even where you met as children)
  • You must meet certain health requirements and character requirements.
  • Social security – if your circumstances indicate that you and your sponsor may have a reliance on Australian Social Security you may require an assurance of support from an Australian Citizen.
    Australian Social values - if you are aged 18 years or over, you are required to sign an Australian values statement and you are required to have read, or had explained to you. Material is made available by the government on life in Australia which is contained in the Life in Australia book.

What about dependants?

When applying for a prospective marriage visa you can include your children and also any other dependent relatives. Depending upon their age they must meet the health, character and Australian Values statement criteria.
