Partner Visa for Australia

Partner visas are for applicants who are married or in de facto relationships with Australian Citizens, permanent residents or qualifying New Zealand Citizens.

What subclass is the partner visa?

There are two types of partner visa
  1. Partner temporary visa (subclass 309) – this is a temporary visa
  2. Partner permanent visa (subclass 100) – this is a permanent visa.

Both of the above allow you to enter and work in Australia but the permanent visa (subclass 100) allows you to also to remain in Australia, qualify for certain social security benefits and possibly receive Australian Citizenship. The temporary visa only entitles you stay in Australia until a decision is made about you permanent residency.

How does the application process work for a Partner Visa?

When making an application for a partner visa, you in effect apply for both the temporary visa (309) and the permanent one (100). The temporary one allows you to enter (as above) whilst a decision is made as to you permanent residency status. This process can take about 2 years.

It may be the case that you do not have to wait for the 2 year period if you meet the following criteria:
  • On application you have been married or in a de facto relationship for a period of three years or more
  • On application you have been married or in a de facto relationship for a period of two years or more and have a dependent child

How long does the temporary visa last for?

The temporary visa usually lasts for as long as the decision making process on the permanent application.

What does Partner Visa allow me to do?

Temporary Partner Visa 309
  • You are entitled to work in Australia and to study in Australia, (you will not have access to government funding)
  • You may enrol in Australia's medical benefits expenses and hospital care scheme, Medicare.
  • You are allowed to enter and stay in Australia until a decision is made on your permanent partner visa application.

Permanent Partner Visa 100
  • Permission to enter or remain permanently in Australia with your partner and you may be eligible for Australian citizenship
  • Entitled to work and study in Australia
  • Able to enrol in Australia's medical benefits expenses and hospital care scheme, Medicare.
    and may be eligible to receive certain social security payments.

What responsibilities does the Partner (sponsor) have?

The partner acts as the sponsor (to the foreign partner) and must prepared to sponsor the applicant and any dependent family members also included in the application and who are migrating with the applicant.

What is the eligibility criteria for a Partner Visa?

There are different criteria according to your marital status for the partner visa application process:

Married Visa Applicants
  • The marriage must be legally acceptable in Australia
  • The sponsor must be an eligible sponsor
  • The Relationship must be exclusive and life long and you must be living together
  • You must meet certain health requirements and character requirements.
  • Social security – if your circumstances indicate that you and your sponsor may have a reliance on Australian Social Security you may require an assurance of support from an Australian Citizen.
  • Australian Social values - if you are aged 18 years or over, you are required to sign an Australian values statement and you are required to have read, or had explained to you. Material is made available by the government on life in Australia which is contained in the Life in Australia book.

De facto applicants
  • You must be over the age 18 when applying for the visa and not related to each other
  • The sponsor must be an eligible sponsor
  • The Relationship must have been for at least an entire 12 month duration prior to the application and you must be in an exclusive relationship and living together.
  • You must meet certain health requirements and character requirements.
  • Social security – if your circumstances indicate that you and your sponsor may have a reliance on Australian Social Security you may require an assurance of support from an Australian Citizen.
  • Australian Social values - if you are aged 18 years or over, you are required to sign an Australian values statement and you are required to have read, or had explained to you. Material is made available by the government on life in Australia which is contained in the Life in Australia book.

What about dependants?

When applying for a partner visa you can include your children and also any other dependent relatives. Depending upon their age they must meet the health, character and Australian Values statement criteria.
