Parent Migrant Visa

The Parent Migrant Visa's is to allow parents to migrate permanently to Australia to join their children. Eligible parents are parents of a child or stepchild who is a settled Australian citizen, settled permanent resident or settled eligible New Zealand citizen. In addition Parents Migration Visas are only available where:
  • The applicant has at least half of their children permanently resident in Australia
  • The applicant has more children living permanently in Australia than any other country

What subclass is the Parents Migrant Visa?

Visa applications under this category are made under subclass 103.

How does the application process work for a Parents Migrant Visa?

There are two classes of Parents Migration Visa.
  1. Non-contributory Parent Visas – Australia only allows a certain amount of these each year and therefore the waiting period can be very long (years).
  2. Contributory Parent Migration Visas – The waiting period for this visa is much shorter as the applicant pays a larger application fee and also submits an assurance of a support bond. In effect this reduces any liability on the state or region allowing for greater numbers to be granted permanent residency and reduce the waiting time.

How long does a Parent Migration Visas last for?

The visa is of a permanent nature.

What responsibilities does the Child (sponsor) have?

There is an obligation on the sponsor to provide a written undertaking to provide support, accommodation and financial assistance for the applicant, and the applicant's accompanying partner and dependent family members, for their first two years of residency in Australia and not rely on state support.
To repay any governmental / state support that is paid to the applicants, their partner or dependants within the first 2 years of their residency.

Most governmental benefits will be subject to a waiting period.

What does this visa let me do?

Apart from allowing the applicant, partner and dependent family members the right to stay in Australia permanently, they may also:
  • Work and study
  • Be eligible to apply for Australian citizenship (subject to the residency eligibility criteria)
  • Sponsor people for permanent residence (subject to waiting periods)

What is the eligibility criteria for a Parent Migration Visa?

I order to qualify for a Parent Migration Visa the following criteria must be met:
  • You must be the parent of a child or stepchild who is a settled Australian citizen, settled permanent resident or settled eligible New Zealand citizen
  • The sponsor must be your child unless they are under 18 then other sponsors may be permitted
  • Have commitment for an Assurance of Support
  • At least half of your children are permanently resident in Australia or you have more children living permanently in Australia than any other country
  • You must meet certain health requirements and character requirements.
  • Australian Social values - if you are aged 18 years or over, you are required to sign an Australian values statement and you are required to have read, or had explained to you. Material made available by the government on life in Australia which is contained in the Life in Australia book.

What about dependants?

When applying for a Parent Migration Visa, you can include your children and also any other dependent relatives. Depending upon their age they must meet the health, character and Australian Values statement criteria.
