UK Visa Tier 2 - General Overview
The aim of the Tier 2 visa application is to provide the opportunity to foreigners wishing to immigrate to the UK by means of covering shortages in the labour market. These include sectors such as engineering, information technology and education as well as those published on the UK skills shortage list.
When the Tier 2 visa application category is launched it will replace the following work permit categories:
- general work permit employment
- ministers of religion
- airport-based operational staff
- overseas qualified nurse or midwife
- sabbatical posts
- seafarers
- named researchers
- Training and Work Experience Scheme
- Jewish agency employees
- overseas media representatives (journalists and other news media)

UK Visa Tier 2 - Who can apply?
Under the new UK points based system there will be 5 Tiers that will cover both employment and student based visa applications for immigration into the UK.
UK visa, Tier 2 applications are for those who have a confirmed job offer from a UK employer and for foreign workers who are not citizens of the European Economic Area.
Tier 2 UK visa applications are designed for medium to highly skilled workers who must be in possession of a certificate of sponsorship.

UK Visa Tier 2 - What is a certificate of sponsorship?
A certificate of sponsorship is obtained from the employer and in line with the Border and Immigration Agency’s risk assessment.
In order to issue a certificate of sponsorship, employers must demonstrate:
- The position is a genuine vacancy
- Remuneration is equal to that which a UK national would receive were they to be employed in the same position.
- The role must also be at or above the National Vocation Qualification (NVQ) level 3.

UK Visa Tier 2 - Does the job have to be advertised?
If the occupation is listed on the shortage occupations list the position does not have to be advertised in the UK before the employer (sponsor) can employ the foreigner.
In the event the occupation is not listed on the shortage list the employer (sponsor) must demonstrate that they have attempted to fill the role within the UK.

UK Visa Tier 2 - Can I get permanent residency?
A Tier 2 UK Visa offers the applicant the opportunity to obtain permanent residency in the UK. Although the Tier 2 UK visa is not a permanent residency visa it does allow for holders to apply for indefinite leave to stay in the UK if they have lived and worked in the UK for a minimum of 5 years.

UK Visa Tier 2 - Can spouses and dependents be included?
A Tier 2 UK visa makes allowance for the dependents and spouses (common law, unmarried and civil) to immigrate to the UK at the same time. As dependents and spouses, of the main Tier 2 UK visa applicant, they will be issued a UK visa for the same period of time and will also be able to seek employment in the UK.

UK Visa Tier 2 - Points based system
An application made for a Tier 2 UK visa is an employer led process, with the employer applying on behalf of the applicant. As per the other tiers, under the new system applicants will be assessed against a points based system.
It is expected that the points based system will be based on:
- Attributes (sponsorship, qualifications, and future earnings)
- Maintenance (your ability to support yourself and any dependents
- English Language Ability

The Tier 2, UK visa criteria is not yet finalised but consensus of opinion indicates that successful applicants will need to score 50 points to qualify.

UK Visa Tier 2 - How will the points be scored?
At this stage the exact methodology behind how points will be scored for the Tier 2 UK visa are not yet known. It is envisaged points will be scored in the following categories:
Qualifications – the higher the qualification, the higher the score will be.
- A PhD qualification
- A Master’s Degree
- A Bachelor’s Degree
- An NVQ level 3 qualification
Prospective earnings – the higher the prospective salary, the higher the score
- 17,000 - 19,999
- 20,000 - 21,999
- 22,000 - 23,999
- 24,000 +
English language proficiency – an acceptable level of English language proficiency will need to shown.
Available funds – applicants will have to demonstrate an amount of funds to carry them over the first month or two.
Skill shortage profession or not – more points will be awarded for occupations that are on the skill shortage list.
